By engaging EMDEV's services or accessing our platforms, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding.
EMDEV (Elmabrouk Development) provides custom software development, SaaS solutions, AI integrations, cloud infrastructure, and technical consulting services. All project scopes are defined in signed proposals or statements of work prior to commencement.
Custom development projects follow milestone-based billing; a deposit of 30–50% is required before work begins, and invoices are due within 7 days of issuance. Online marketplace purchases (digital courses, software subscriptions) are processed immediately and securely via Paddle, our authorized Merchant of Record and payment processor. All prices are displayed in USD unless otherwise stated. Late payments on custom projects may result in work suspension.
Upon receipt of final payment, clients receive full ownership of all custom-developed code, designs, and deliverables. Digital products purchased through our marketplace — such as MaxSkills e-learning courses — grant the purchaser a personal, non-transferable license for the stated access period only and do not transfer ownership of the underlying content or platform. EMDEV retains the right to display completed custom projects in its portfolio unless a non-disclosure agreement is signed.
EMDEV treats all client information, project details, and business data as strictly confidential. We do not share, sell, or disclose any client information to third parties without explicit written consent.
EMDEV's total liability is limited to the fees paid for the specific project in question. We are not liable for indirect, incidental, or consequential damages arising from the use of delivered software or services.
These terms are governed by the laws of the Republic of Tunisia. Any disputes not resolved through mutual negotiation shall be subject to the jurisdiction of Tunisian courts.
